CONSTITUTION OF INDIA EXPLAINED

The Constitution of India forms the bedrock of any and every Judicial Service exam in the country. Its thorough knowledge is a must for all aspirants of RJS, DJS, PCS (J) and every other Judicial Service exam. Article 91

  • When office of Chairman is vacant or
  • when Vice-President is acting as President
    • his duties are to be performed by Deputy Chairman
  • If Deputy Chairman’s office is also vacant
    • Chairman’s duties are to be performed
    • by a member of Council appointed by President
  • When Chairman is absent
    • Dy. Chairman shall act as Chairman
  • If Dy. Chairman is also absent
    • a person as determined by rules of procedure shall act as Chairman
  • If no such person is present
    • any other person as determined by the Council shall act as Chairman

Article 92

  • When resolution for removal of VP is considered
    • Chairman shall not preside, even though present
  • When resolution for removal of Dy. Chairman is being considered
    • Chairman shall not preside, even though present
  • Provisions of Article 91 apply
    • as if Chairman / Dy. Chairman is absent
  • Chairman has the right
    • to speak in and take part in proceedings of his removal
    • but he shall not be entitled to vote at all on such resolution

Article 93   Officers of Lok Sabha

  • Lok Sabha shall choose
    • one of its members as Speaker and
    • another member as Dy. Speaker
      • as and when these offices become vacant

Article 94

  • Removal of Speaker/Dy. Speaker:
    • by a resolution of the House
    • passed by a majority of all the then members

On dissolution of the House:

  • Speaker to continue in his office
    • until immediately before the first meeting of the new House

Article 95

  • When Speaker’s office is vacant
    • his duties are to be performed by Dy. Speaker
  • When Dy. Speaker’s office is also vacant
    • Speaker’s duties are to be performed
    • by a member of the House appointed by President
  • When the Speaker is absent
    • Dy. Speaker to act as Speaker
  • When Dy. Speaker is also absent
    • a person determined by rules of procedure, to act as Speaker
  • When no such person is present
    • a person determined by the House to act as Speaker

Article 96

  • During removal proceedings of the Speaker
    • he shall not preside, though he is present
  • Similar provision for Dy. Speaker
  • Provisions of Article 95 to apply
    • as if Speaker/ Dy. Speaker is absent
  • Speaker has the right
    • to take part in his removal proceedings
  • He is entitled to vote on such resolution
    • only in the first instance
    • but not in the case of an equality of votes

Article 97   Salaries of officers

  • Salaries and allowances of
    • Chairman, Dy. Chairman
    • Speaker, Dy. Speaker
  • to be fixed by Parliament by law

Article 98   Secretariat of Parliament

  • Each House shall have
    • a separate secretarial staff
  • Recruitment and conditions of service of such staff
    • to be regulated by Parliament by law

Article 99   Oath by members

  • Every member of either House
    • to make oath
    • before the President or a person appointed by him
    • before taking his seat

Article 100   Voting in Houses

Except when otherwise provided:

  • All questions in either House or in a joint sitting to be determined
    • by majority of votes of members present and voting
    • other than Speaker or
      • person acting as Speaker or Chairman

Casting Vote

  • Chairman or Speaker or person acting as such
    • shall not vote in the first instance
    • but shall exercise a casting vote in case of equality of votes

Validity of Proceedings

  • Proceedings in Parliament to remain valid
    • even when discovered subsequently
    • that a person not entitled to sit or vote had done so

Quorum:

  • 1/10th of total number of members
  • Ensuring quorum is responsibility of Presiding Officer
